Terms of Service
These Terms govern your use of the Heed mobile application (the “App”), developed by Elias Nieto (“we”, “us”, “our”). By using the App, you agree to these Terms.
1. Use of the App
Heed is provided free of charge for personal, non-commercial use. You agree to use the App in compliance with applicable laws.
2. Account
To use Heed, you must sign in using Apple's “Sign in with Apple” service. You are responsible for keeping your Apple ID secure. You may sign out at any time from within the App, which deletes your account-related data from our systems.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on iOS devices that you own or control, in accordance with these Terms and Apple's App Store Terms of Service.
You may not:
- Reverse engineer, decompile, or attempt to extract the App's source code.
- Use the App for any unlawful purpose.
- Resell, redistribute, or sublicense the App.
4. Phone usage tracking
Heed estimates your phone usage by listening to lock and unlock events. While we strive for accuracy, the data shown in the App is approximate and may not perfectly reflect your actual usage, especially in the following cases:
- The App was suspended by iOS in the background.
- Background App Refresh is disabled.
- The device was restarted.
You should not rely on Heed's data for any clinical, legal, or commercial purpose.
5. No warranty
The App is provided “AS IS” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free, or secure operation.
6. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.
7. Service availability
We may modify, suspend, or discontinue the App (in whole or in part) at any time, with or without notice. We are not liable to you or any third party for any such change.
8. Third-party services
The App relies on services provided by Apple Inc. (Sign in with Apple, CloudKit, iCloud). Your use of those services is also governed by Apple's terms and privacy policies.
9. Changes to these terms
We may update these Terms occasionally. The “Last Updated” date at the top will reflect any changes. Continued use of the App after changes constitutes acceptance of the new Terms.
10. Governing law
These Terms are governed by the laws of Belgium. Any dispute arising from your use of the App will be subject to the exclusive jurisdiction of the Belgian courts, except where mandatory consumer protection law of your country of residence provides otherwise.
